
Total and Permanent Disability (TPD) Claims
Many people hold total and permanent disability cover through superannuation without being aware of it, and cover may exist across several funds at once. Where illness or injury has ended a person's working life, these policies can provide a lump sum benefit that is separate from, and additional to, any compensation claim.
Entitlement is determined by the wording of the policy rather than by the severity of the condition alone. Definitions vary between policies, particularly in whether they measure capacity for the person's own occupation or for any occupation for which they are reasonably suited by education, training and experience. We review the policy terms before the claim is prepared.
Preparation is what determines most outcomes. A claim rests on medical evidence, employment history, and a clear account of the effect of the condition on the ability to work. Material that is incomplete or inconsistent is a common reason for declined claims, and it is far easier to prepare a claim properly than to repair one later.
Where a claim is declined, the decision is not final. We advise on internal review, complaints to the external dispute resolution scheme, and proceedings where necessary, and on the tax treatment and release of any benefit paid.
