Impairment Benefits and Lump Sum Entitlements

Most compensation schemes provide a lump sum where an injury results in permanent impairment. Entitlement depends on an assessment of impairment carried out under prescribed medical guidelines, and the resulting figure determines both whether a payment is made and, in many cases, whether other rights become available.


Timing matters. An assessment carried out before an injury has stabilised, or before all affected body systems have been properly considered, can produce a figure that understates the true position. We advise on when an assessment should be sought and ensure that every relevant aspect of the injury, including psychological effects, is placed before the examiner.


Independent medical examinations are a significant step and clients are entitled to be prepared for them. We explain the purpose of the examination, what the examiner will assess, and how the appointment ordinarily proceeds, so that the process is not unfamiliar or unnecessarily stressful.
